PUBLIC NOTICE of Intention to File a CLASS ACTION LAWSUIT in the Federal Court of Jurisdiction for Kern County, California as follows: Mike Sinnott, Trustee of the Pauline B. Sinnott Revocable Family Trust, Plaintiff v. Indian Wells Valley Groundwater Authority et al.

This is a Public Notice of intention to file a Class Action lawsuit against
Indian Wells Valley Groundwater Authority et al.
on behalf of Property Owners in the Indian Wells Valley, Property Owners and Ratepayers in the Indian Wells Valley Water District, and others who may be suffering from financial damages due to the actions of the Indian Wells Valley Groundwater Authority and The United States Navy.
The Board of Directors of the Indian Wells Valley Groundwater Authority includes Kern County, Inyo County, San Bernardino County, the City of Ridgecrest and the Indian Wells Valley Water District.
The U.S. Navy has asserted Federal Reserve Water Rights, which was accepted and approved by the IWVGA and resulted in the allocation of 7,650 acre feet per year in “federal reserve water rights” to the U.S. Navy. The IWVGA has determined that the “Sustainable Yield” of the Indian Wells Valley Groundwater Basin “The Basin”, is 7650 acre feet per year. Attorneys representing Searles Valley Minerals, a mining company in Trona, California, have publicly stated that the Navy’s assertion of Federal Reserve Water Rights is “laughable and a Question of Law, at best”.
The Indian Wells Valley Water District is now being compelled to collect “IWVGA Fees” from customers of the Indian Wells Valley Water District to be disbursed to the IWVGA as “Replenishment Fees” and all property owners in the Indian Wells Valley are potential members of the Class, including those property owners in the Indian Wells Valley Water District and property owners in Trona, California, County of San Bernardino.
Indian Wells Valley Water District has filed a “Comprehensive Adjudication” lawsuit against the Indian Wells Valley Groundwater Authority.
Searles Valley Minerals is also being compelled to pay “Replenishment Fees” and has also filed a “Comprehensive Adjudication” lawsuit against the Indian Wells Valley Groundwater Authority.
Mike Sinnott, as Trustee of the Pauline B. Sinnott Revocable Family Trust, intends file as the Plaintiff in the Class Action to be filed and will be retaining an Attorney to represent the Class Members in this Action.

PUBLIC NOTICE: I intend to file a Class Action lawsuit in Federal District Court and will request an immediate Injunction prohibiting the Indian Wells Valley Groundwater Authority from collecting the Basin Replenishmet Fee aka “IWVGA Fees” from property owners or ratepayers in the Indian Wells Valley Water District.
